TERMS & CONDITIONS

Between the Sarah Wong Photography and Client, it is agreed that Sarah Wong Photography will provide the following services: guidance and direction before, during, and after your session, coverage as discussed for your session package, and a online photo viewing/download gallery via private link.

Agreement: The person whose signature appears on contract, known as "Client", agrees that Sarah Wong, known as "Photographer", shall provide services to photograph their portrait session and related events to the best of her abilities, in the manner described in this document. This is a binding contract that incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement. Client assumes responsibility for all collection costs and legal fees incurred by Photographer should enforcement of this contract become necessary. In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this agreement.

Payment: Client shall reserve the time and date of services by electronic sign-up through meetme.so/sarahwong, known as "Instant Booking". No holding fee is required for Instant Booking. The session payment due for the photography services must be paid in full on the day of the session unless otherwise prior arrangements are made noted in writing. In the event Client fails to conduct payment as specified, the Photographer shall have the right to immediately terminate this Agreement and withhold photos from Client. Sarah Wong Photography prefers payments via cash, check, credit card through PayPal, or Venmo. In the case where a Client discusses custom packaging and pricing options, known as "Custom Booking", a holding fee fee is subject to exist. No date is reserved until the contract and holding fee is received for Custom Booking. The balance due for the photography services (remainder of the Custom Booking session fee) must be paid in full on the day of the session. In the event Client fails to remit payment as specified for Custom Booking, the Photographer shall have the right to immediately terminate this Agreement with no further obligation, retain monies already paid, and not attend the session.  Unless the contract is cancelled, the holding fee shall be applied to the Custom Booking fee total.

Cancellation & Rescheduling: In the event that Client reschedules an Instant Booking or Custom Booking session less than 24 hours in advance of Client's original session for non-emergency reasons, a $20 charge will be applied to move the session to a different date atop the session fee. In the case of Instant Booking, no cancellations can be made less than 24 hours. Client must re-book session subject to the additional $20 re-booking charge. In the case of cancellation of Custom Session made any time before the session date, Photographer will keep the non-refundable holding fee. Cancellation must be made in writing, and signed by the contracted party.

Coverage: Photographer will provide coverage for the dates, locations, and continuous hours specified in the Instant Booking or Custom Booking session. Additional travel or coverage hours may be added by agreement prior to the session day and must be paid in full before any photos are released to Client. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised in Client's final images. Images determined by the photographer to be substandard or duplicated may be edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client.

Copyright: All photographs taken by Sarah Wong Photography by Sarah Wong are her property and are protected by United States Copyright Laws (USC Title 17). Client hereby waives any claims for ownership, income, and editorial. It is a violation of federal copyright law to copy, scan, or allow photographs the Photographer has created to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered (digitally or otherwise), without the Photographer’s express written permission. Digital files remain her sole property until purchased by the Client (a USB of separate image files purchased from Photographer).

Reproduction: Client agrees to purchase prints directly from Photographer unless in purchased possession of full-resolution digital files (a USB of separate image files purchased from Photographer). Client agrees not to scan, copy or reproduce images in any manner without written permission. Should Photographer become aware of reproduction without permission, Client will remit a usage fee of $300 per image, per usage to Photographer. If full-resolution digital files are purchased, a print release will be supplied with those files. The release grants Client the right to reproduce the images provided for their personal use only and does not allow the photos to be altered, sold or published. Client further agrees not to supply images to any third parties (including vendors associated with the session or album designers). If a USB or digital negatives are provided as part of the session photography agreement a letter of release can be provided for client to print photos for personal use only.

Model Release: This contract serves as a model release giving the Photographer the irrevocable right to use the photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. This release is binding on the Client, their legal representatives, heirs, and assigns. 

Holding Fee: At this time, a holding fee is due for Custom Booking unless otherwise discussed. If a holding fee is required, Photographer will note the holding fee in writing prior to the signing of this contract. If a holding fee is required for your Custom Booking session, Client may meet with Photographer in person or send to Photographer's mailing address provided in discussion to deliver payment. Your session is locked in once payment is received.
